Georgia, Tennessee Become Latest to Protect Gun Purchasers’ Privacy

Georgia and Tennessee last week became the newest members of the coalition of states to ban credit card companies from recording sensitive information about gun purchases. There are now 14 states that prohibit this controversial practice.

Gov. Brian Kemp (R) signed HB 1018, the Second Amendment Privacy Act, into law on Monday to prevent the implementation of a Merchant Category Code (MCC) by financial institutions in Georgia. 

This would permit them to assign firearms and ammunition transactions to a specific category when the customer used a credit card for the purchase. 

The Peach State statute goes further, preventing discrimination against a firearm retailer over the use or non-use of an MCC. It also expressly forbids the establishment of a registry or list of firearm ownership.

As every reasonable person knows, such a practice is the first step toward confiscation.

On the following day just to the north, Tennessee Gov. Bill Lee (R) put his signature on SB 2223. Like the Georgia law, it also banned the use of an MCC specifically for firearm and ammunition transactions.

In Sept. 2022, Visa became the first credit card company to bend the knee to antigun groups and announce the implementation of such a code. The Wall Street giant was quickly followed by Mastercard, Discover and American Express with plans to flag these purchases.

But by March, there was enough pushback from states that supported the Second Amendment that the program’s rollout was paused. It proved to be a temporary victory for gun rights.

California then passed a law, which takes effect next year, to mandate such tracking. This led to the current surge of states fighting back on behalf of their citizens to protect their confidential information from being collected.

The issue certainly appears to be headed to the courts.
